《人权与公民权宣言》简称《人权宣言》。法国大革命中的重要文献。全文除前言外共17条，扼要列举了资产阶级的政治纲领和宪法原则，1789年 8月20～26日由国民议会通过，后经局部修改作为序言冠于1791年颁布的宪法之首，实际上是制订宪法的基本原则。《宣言》受到17世纪英国革命时期平等派的《人民公约》和18世纪美国的独立宣言的启示，其哲学基础是J.洛克和 J.-J.卢梭等启蒙学者的"自然法"和"社会契约"思想。改变法国封建制度和社会不平等状况是资产阶级制订《人权宣言》的主要目的。(见彩图) 《宣言》认为："无视、遗忘或蔑视人权是公众不幸与政府腐败的唯一原因"（前言）；"人们生来而且始终是自由的，在权利上是平等的"（第1条）,"这些权利就是自由、财产、安全和反抗压迫"(第2条);"一切主权的本原主要寄于国民，任何团体、任何个人均不得行使未由国民明确授予的权利"（第3条）;"所有公民都有权亲自或经过代表参与制订法律，......在法律面前人人平等"；"未经法律规定,不按法律手续,不得控告、逮捕或拘留任何人"（第7条）;"一切公民都有言论、著作、出版的自由"（第11条）；"凡权利无保障、分权未规定的社会，等于没有宪法"（第16条）；"财产是神圣不可侵犯的权利"（第17条）。《人权宣言》的颁布对法国大革命起了极大的推动作用，它的传播在欧洲引起了强烈震动。随着革命的深入,1793年6月24日国民公会通过的宪法部分修改了《人权宣言》,规定"社会的目的是求得共同幸福" (第1条)；人民享有劳动权、救济权、教育权(第2、11、22条);承认人民有起义权（第23条）。但是这部宪法并未实施。共和三年(1795)宪法虽仍冠以《人权宣言》，但对内容作了重大修改：《宣言》第1条被删去,既不提"共同幸福"，也不提思想、言论自由，并在权利之外增加"义务"条款。《宣言》改称为《人权、公民权与义务宣言》。共和八年（1799）宪法则根本取消了《人权宣言》。直到1946年通过的第四共和国宪法才以"前言"形式再次明确规定人民的各种权利，并补充关于保障妇女、儿童权利等条款。1958年的第五共和国宪法重申遵守《宣言》，并确认1946年宪法对人权内容的补充。
