扶养扶养maintenance特定亲属间一方须对他方承担生活供养责任的法律关系。前者称为扶养义务人，后者称为扶养权利人。中国古代的礼和法规定，同居生活的家属均不得有私财，生活由掌握家庭财产的成员负责供养。子、孙对父母、祖父母供养有阙，须按不孝治罪。近、现代各国法律一般都把因亲属关系而发生的经济义务统称为扶养。瑞士等国的民法还把扶养义务分为两种，一种是夫妻间、父母子女间的扶养义务，称生活保持义务；另一种是其他一定范围亲属间的扶养义务，称生活扶助义务。按照一些国家的立法，扶养的范围主要包括配偶、直系血亲、兄弟姐妹等。有些国家的法律还规定，家长与亲属间、夫妻一方与同居生活的他方父母间互有扶养义务。如扶养义务人不止一人，或扶养权利人不止一人而义务人的能力不足以扶养其全体时，则以法律来确定承担义务、行使权利的顺序。一般说来，不论是扶养义务人还是扶养权利人的顺序，各国法律多规定以配偶、直系血亲为先，同为直系血亲者以亲等近者为先。扶养义务的履行，以权利人无法维持生活，义务人有负担能力为前提。关于扶养的方法和程序，许多国家在法律上都有具体规定。《中华人民共和国婚姻法》（1980）对扶养一词采取狭义解释，专指夫妻双方在生活上的互相供养。该法规定：“夫妻有互相扶养的义务”，“一方不履行扶养义务时，需要扶养的一方，有要求对方付给扶养费的权利”。关于父母对子女，祖父母、外祖父母对孙子女、外孙子女，成年兄、姊对未成年弟、妹的供养称为抚养。子女对父母，孙子女、外孙子女对祖父母、外祖父母的供养称为赡养。中国刑法规定的扶养，则采取广义的解释，包括抚养和赡养，并规定对有扶养义务而拒绝扶养，情节恶劣的，应追究刑事责任。
