关于新西兰工签政策变化,本号已经在5月份做过初步解析【移民局动向预警】新西兰史上最严厉的工签改革知多少。

今天,移民局亲自实锤了此次工签改革。计划中的大部分改革对雇主的影响要大于对移民工人的影响,而且要到才会实施。那么,将会产生影响的改革有哪些呢?。

一、工签改革时间线

允许低薪或低技能等级工人担保配偶和孩子的旅游签证;仅以工资作为技能等级的评判标准,按照目前的平均工资中位数标准,时薪高于25纽币的为高技能工作,低于25纽币的为低技能工作。

.10.7取消银蕨签证;认可雇主最低年薪从5.5万纽币增至79,560纽币,且高薪工人不可直接申请永久回头签。

用1个新的临时工作签证代替6个临时工作签证(基本技能工签、认可雇主工签、长期短缺工签将不能申请);

改进雇主聘用移民工人的流程,雇佣移民工人的雇主需要进行认证。

二、不受影响的工签类型

认可季节性雇主签证(RSE);

打工假期签证;

毕业后工作签证;

渔船船员工作签证;

宗教工作者工作签证;

特殊目的工作签证;

合作伙伴工作签证,包括工作签证的合作伙伴、新西兰工作签证的合作伙伴和学生工作签证的合作伙伴;

因国际或人道主义理由签发的工作签证,例如外交官、领事和正式工作人员的工作签证,以及难民或索赔保护申请人的工作签证。

三、雇主改革

取消基本技能工签原则性批准;

取消认可雇主计划;

所有雇佣移民工人的雇主都必须被认证;

雇主认证分为三类:标准认证(一年雇佣1-5名移民工人)、高质量认证(一年雇佣6名以上移民工人)、劳务认证;

首次雇主认证有效期为12个月,更新认可有效期为24个月;劳务认证每12个月更新一次;

奥克兰、惠灵顿、基督城、汉密尔顿、但尼丁以外地区的工作无须进行劳动力市场测试;

超过平均工资中位数的工作无需进行劳动力市场测试;

长期短缺清单上的工作无需进行劳动力市场测试;

ANZSCO将被用于评判工资是否与市场水平匹配,以及应聘者的资质是否足够;

雇主认证时间、费用、流程、所需资料、无法预知移民工人人数时该申请哪种类别的认证方式待定。

四、居留签证的影响

认可雇主居留签证将取消;

长期短缺清单居留签证将取消;

1&2项持有新的临时工签申请居留签证需具备两个条件:超过工资中位数200%,以及在新西兰从事高薪工作两年以上。

1&2项可申请基本技能工签。

由此可见,此次工签改革受影响最大的主要是两类工签申请人:认可雇主(又称白名单雇主)和长期短缺清单,即原先的两类WTR申请人。

01工作签证政策变化

移民部长宣布改变雇主担保移民工人获得临时工作签证的方式。

一、临时工作签证变更公告

从现在到,我们将改革雇主招募移民到新西兰做临时工作的方式。这些改革将分阶段实施,并于全面施行。

二、改革包括

我们将:

1.开发一个新的雇主主导的签证申请流程;

2.引入新的临时工作签证,取代现有的6个工作签证;

3. 用薪酬水平来代替现有的技能等级对工作进行分类——现有的技能等级依赖于薪酬水平和ANZSCO下工作分类的组合;

4.加强对低收入工作的劳动力市场测试,为农村地区和城市清单上的高薪工作提供开放的机会;

5.引入行业协议,为目标行业的移民提供便利;

6.恢复低收入工人的家人持旅游签证来新西兰的权利。

新流程将在未来18个月内设计完成,因此还有很多细节尚未公布。这些信息包括费用、处理时间以及雇主和移民必须提供的支持其申请的证据。

第一轮改革将于10月7日实施,只会影响人才认可雇主。

三、雇主将主导雇佣海外工人的流程

从开始,需要雇佣海外工人的雇主将使用一套三步流程来申请临时工签。

雇主核实——所有雇主,包括已获认可的雇主,均须在新申请程序下获得认可,才能用新工作签证聘请移民工人。

工作核实——这将包括核实工作的报酬是否符合新西兰市场价格,在某些情况下,还将包括劳动力市场测试,以确保新西兰工人无法胜任该工作。

工人核实——当工人申请签证时,他们必须证明他们符合我们的性格标准、身份和健康要求,同时也要证明他们有能力胜任他们被提供的工作。

四、雇主主导流程预期取得的效果

02人才(认证雇主)工作签证变化

从10月7日起,我们将更改人才(认可雇主)工作签证。

一、改革包括

1.将最低年薪从55000纽币增加到79 560纽币

2.如你申请人才(认可雇主)居留签证,则取消获得永久居民签证的选项;及

3.雇主认可的时限为24个月以内。

二、提高最低年薪

作为一名移民,申请人才(认可雇主)工作签证的最低工资将从每年5.5万纽币提高到79,560纽币。

新工资适用于我们从10月7日起收到的所有人才(认可雇主)工作签证申请,无论雇主何时获得认可。

工资门槛上一次更新是在。新标准是目前新西兰工资中值的150%,并将根据收入中值每年更新。

如果从10月7日起你的工资低于79,560纽币,你可以申请基本技能工作签证。

三、取消获得永久居民签证的选项

从10月7日起,如果你没有人才(认可雇主)工作签证或目前没有申请该签证,你申请人才(认可雇主)居留签证时将不能获得永久居民签证。

目前,如果你有一个人才(认可雇主)工作签证,并且你年薪在9万纽币以上,你可以申请一个人才(认可雇主)居留签证和永久居民签证。

如果你已经获得了人才(认可雇主)工作签证,以后你仍然可以申请永久居民签证。

四、雇主认可时限为24个月内

从10月7日起,申请认证的雇主在重新申请之前只能获得24个月的认证。这一限制是为了允许我们对雇主招聘移民工人的方式做出一些改革。

如果您已经获得认证,在您重新申请认证之前,此限制不会影响您。

五、如果你现在想申请雇主认可

确保你能付给移民工人员至少79,560新西兰元。目前我们需要3个月的时间来处理认可雇主的申请,所以你需要满足新的工资限制。

六、如果你有一个人才(认可雇主)工作签证或已在107日前申请

您不受这些变化的影响,您的签证条件和期限也不会改变。

如果你后期申请人才(认可雇主)居留签证,你的年薪只需要达到55,000纽币以上。

如果你的工资是9万纽币或以上,当你申请人才(认可雇主)居留签证时,你可能有资格获得永久居民签证。

七、如果你的雇主没有更新他们的认可

如果你有工作签证,你仍然可以继续为他们工作。

如果你不想再为你的雇主工作,你可以申请改变签证条件,这样你就可以为其他雇主工作了。

02Changes to the Talent(Accredited Employer) Work Visa

Tuesday, 17 September From 7October we are changing the Talent (Accredited Employer) Work Visa.What we are changingWe are:·increasing the annual salarylimit from NZD $55,000 to NZD $79,560·removing the option to get aPermanent Resident Visa if you apply for a Talent (Accredited Employer)Resident Visa, and·limiting the amount of timeemployers can be accredited to 24 months.Increasing the minimum salaryAs amigrant, the minimum salary you need to apply for a Talent (AccreditedEmployer) Work Visa will increase from NZD $55,000 to $79,560 a year.The newsalary applies to all Talent (Accredited Employer) Work Visa applications wereceive from 7 October, regardless of when the employer became accredited.The salarythreshold was last updated in .
